Terms of Service

1. Acceptance of Terms

By accessing and using MogIts ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

MogIts is a 1v1 appearance battle platform where users can:

• Upload photos and create battles (free or paid)
• Challenge other users or accept open challenges
• Vote on active battles
• Earn money by winning paid battles
• Compete for rankings and gain status on the leaderboard

3. Paid Battles and Earnings

3.1 Battle Entry Fees

Users can create paid battles by setting an entry fee. When creating a paid battle:

• You must pay the entry fee upfront via Stripe
• Your opponent must also pay the same entry fee to accept the challenge
• The total prize pool is the sum of both entry fees
• All payments are processed securely by Stripe

3.2 Platform Fee

MogIts charges a 10% platform fee on all paid battles. This fee covers:

• Platform maintenance and hosting
• Payment processing fees
• Customer support
• Feature development and improvements

Example: If both users pay $10 entry fee, the total pool is $20. The winner receives $18 (90%), and MogIts keeps $2 (10%).

3.3 Winning and Payouts

Battle winners are determined by community votes:

• The user with more votes at the end of the battle duration wins
• In case of a tie, no winner is declared and entry fees are refunded
• Winners receive 90% of the total prize pool
• Payouts are processed automatically via Stripe Connect
• You must connect a Stripe account to receive payouts

3.4 Refunds and Cancellations

Before Battle Starts: If you cancel a battle before an opponent accepts, you will receive a full refund minus Stripe processing fees (~3%).

After Battle Starts: Once an opponent accepts and the battle goes live, no refunds are available. The battle must be completed.

Tie Results: If a battle ends in a tie (equal votes), both participants receive their entry fees back minus platform fees.

3.5 Tax Responsibilities

You are responsible for reporting your earnings:

• If you earn over $600 in a calendar year, we will issue a 1099 tax form
• You must report all earnings on your tax returns
• MogIts is not responsible for your tax obligations
• Consult a tax professional for guidance

3.6 Payout Processing

Payouts are processed automatically when a battle ends:

• Payouts are sent to your connected Stripe account
• Stripe typically processes payouts within 2-7 business days
• You must verify your identity with Stripe to receive payouts
• Minimum payout amount: $1.00

4. User Account and Security

To use certain features of MogIts, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Content Ownership and Rights

You retain ownership of photos you upload. By uploading content to MogIts, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on the Platform.

You represent and warrant that you own or have the necessary rights to upload any content to the Platform.

6. Reputation and Rankings

MogIts uses a community-based ranking system to track user status:

• Rankings are updated based on battle wins and losses
• Votes are calculated automatically by our scoring algorithm
• You can view your current stand in the global leaderboard

7. Prohibited Content and Conduct

You agree not to upload any content that:

• Is illegal, harmful, threatening, or abusive
• Is defamatory, obscene, or otherwise objectionable
• Infringes on any intellectual property rights
• Contains software viruses or any other harmful code

8. Battle Rules and Fair Play

Users must adhere to the following rules:

• No vote manipulation or bot voting
• No creating multiple accounts to vote on your own battles
• No harassment or bullying of other users
• Battles must be completed fairly without interference

We reserve the right to disqualify users, reverse battle results, or withhold payouts in cases of suspected fraud, manipulation, or violation of these terms.

9. Dispute Resolution

If you have a dispute regarding a battle result or payout:

• Contact us via the contact form within 7 days of the battle ending
• Provide evidence of any suspected rule violations
• We will investigate and make a final determination within 14 business days
• Our decision is final and binding

Chargebacks: If you initiate a chargeback with your payment provider, your account will be immediately suspended pending investigation. Fraudulent chargebacks may result in permanent account termination and legal action.

10. Termination

We reserve the right to terminate or suspend your account and access to MogIts at our sole discretion, without notice, for conduct that we believe violates these Terms of Service.

11. Limitation of Liability

MogIts shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Platform, including but not limited to:

• Loss of earnings or profits
• Payment processing delays
• Technical issues or downtime
• Disputes with other users

Our total liability to you for any claims arising from your use of MogIts shall not exceed the amount you paid to us in the past 12 months.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on the Platform.
